Conflicting demands as to claims adjusting and litigation management between insurance claims professionals and attorneys has been an ongoing challenge. However, the COVID-19 pandemic created further disconnect and tensions in the industry. While virtual meetings and conference calls have assisted in bridging the gap associated with loss of personal interaction, it’s not enough. Increased mobility of insurance claims professionals between companies, economic and socio-economic pressures, early retirement of experienced law partners, and hopping of associates between law firms, have all exacerbated the lack of cohesion in messaging regarding task advancement and objectives. Strain on third-party vendor capacity, creating delays in expert analysis of liability, damages, and allocation of fault has created additional pressures. Unpredictability of courts, social inflation, lack of civility between attorneys, as well as the constant rescheduling of hearings and depositions, has created a perfect storm, resulting in heightened frustration and dissatisfaction from both sides of the industry. This panel session will be a point-counterpoint discussion between experienced claims professionals and defense counsel, hashing out the challenges each side of the same industry faces, and sharing new perspectives facilitating improved communication and understanding to bridge this widening gap.
