Cynthia Tarle

Cynthia is the Founder of Tarle Law, P.C. and is the Managing Director of the solely owned women practice with offices strategically located in Southern California and Central Texas, which serve to support clients’ multi-state needs.  Tarle Law, P.C. has been formerly designated as a WOSB (Women Owned Small Business) Firm.  Among other awards, she has been honored with Distinguished Membership by the Civil Litigation Section of the Lawyers of Distinction for 2015-2016.

Cynthia has a diverse practice in which she is actively retained by clients in relation to everything from drafting of contracts and conducting negotiations, including insurance program development and procurement with underwriters, to litigating matters through arbitration or trial.  She handles general liability matters, including litigating personal injury and premises liability lawsuits and is frequently retained to defend clients in construction defect and accident actions, as well as product liability matters.    Cynthia has garnered substantial recognition in the nuclear insurance and energy fields for her work in advising and consulting clients as to insurance coverage and the negotiation of policy language with underwriters during the procurement process, as well a drafting of risk transfer, indemnity and damages provisions which uniquely address this industry.  She has an active commercial and business transaction practice, including developing master services agreements and terms of use requirements for proprietary programs developed by clients and acts as monitoring counsel for clients at a national level.

Cynthia has developed a strong reputation in the industry for her representation of owners and contractors in commercial, multi-use, condominium complexes, industrial, governmental and residential, as well as school district and university construction matters. She represents several NASDAQ and NYSE-listed, Fortune 500 companies, owners, developers, general contractors, architects, engineers, suppliers and subcontractors in the construction industry, directing contract negotiations, as well as representing her clients in litigation with regard to allegations of breach of contract, negligent design, defective construction, standard of care, product liability, land subsidence, pollution, and statutory violations. She is well-versed in the handling of multi-party, court designated complex actions, involving a multitude of litigants in which allocation of liability and damages, as well as assessment of risk transfer is crucial.

Cynthia is frequently retained to analyze coverage issues related to a variety of liability policies, Controlled Insurance Programs/WRAP policies, builder’s all risk, as well as environmental, pollution, marine and professional liability insurance. She counsels clients as to interpretation of policy exclusions and endorsement provisions. Cynthia’s practice extends not only to the development and negotiation, from both the contract and underwriting side, of Owner and Contractor Controlled Insurance Programs, working with the most prominent insurance brokers in the industry world-wide in order to create effective programs for her clients, but also to litigating claims arising out of such programs.  Cynthia’s clients benefit substantially by having access to her in-depth understanding of the contracting and underwriting side of Controlled Insurance Programs and how that may affect their liability, exposure and participation in such programs when litigation ensues. She has also expanded her practice into the nuclear energy industry, consulting on the delicate inter-play of conventional policies. She is frequently asked to lecture and present seminars to groups across the country with regard to construction and insurance issues.
